Terms of Use

These Terms of Use replace the Terms of Use that appeared before you logged into the One Zurich Application (“App”).

Zurich reserves the right to update and change these Terms of Use from time to time in order to reflect any changes to the legal, regulatory and/or compliance-related requirements.

General

The App is an all-in-one employee mobile application that provides a modern, streamlined way to manage day-to-day work-related activities. The App helps to improve the employee experience, giving you a convenient way to stay connected and save time.

The App is intended to provide:

A smart building enabled, digitally interactive workplace experience for Zurich staff to Zurich offices. The services provided by this App include travel, events, booking and building services (“Services”);
Mobile access to your HR data;
Mobile access to IT support; and
Mobile access to Zurich news and communications.

This App is provided to you in the US by Zurich American Insurance Company, its US affiliates and in Canada by Zurich Canadian Holdings Limited (collectively referred to as (“Zurich”, “we”, “our” or “us”).

Please read these Terms of Use carefully as they apply to your access to and/or use of any information, content, materials or features/functions provided through the App that are related to the available Zurich locations.

It is up to you to decide whether you would like to make use of the Services or App. By clicking the “I agree” button, you acknowledge your agreement with and your understanding of these Terms of Use. If you do not agree to these Terms of Use, you may not use this App.

If you select a Zurich location in another country, the available regional Terms of Use of that country apply.

Permission to Use the App

The App is owned by Zurich and its licensors. Zurich grants you a non-exclusive license to download and install the App onto a device that you own or control.

If you sell any device on which the App is installed, you must remove the App and any Zurich content from the device before you deliver the device to the buyer.

This is a licence, not a sale. That means that Zurich and its licensors continue to own the App including, but not limited to, the Services when the App is installed on your device.

User Representations

By using this App, you represent and warrant that:

all information you submit is and will be true, accurate, current, and complete;
you will keep your credentials (such as user IDs, passwords and other access credentials) secure and will not share your access credentials with any other person or entity;
in case of known or suspected misuse of credentials by any other person, or loss of your device, you will promptly notify Zurich and change your access credentials immediately; and
you have the legal capacity and you agree to comply with these Terms of Use.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of this App and the Services connected thereto (or any portion thereof).

When accessing, using or posting any content or information in this App, you may not:

post or transmit any unlawful, threatening, abusive, libellous, defamatory, obscene, pornographic, profane or otherwise objectionable information of any kind, including without limitation any transmissions constituting or encouraging conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any national or international law;
interfere with the functioning of this App or restrict or inhibit any other user from using this App;
post, publish, transmit, reproduce, distribute or exploit any information, software or other material obtained through this App for commercial purposes without the prior written consent of Zurich;
decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the App;
post or upload content or information to this App, in which you do not own the respective rights;
retrieve data or other content from the App to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from Zurich;
make any unauthorized use of the App, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses;
circumvent, disable, or otherwise interfere with security-related features of the App, including features that prevent or restrict the use or copying of any content;
trick, defraud, or mislead Zurich and other users, especially in any attempt to learn sensitive account information such as user passwords;
make improper use of Zurich support services or submit false reports of abuse or misconduct;
attempt to impersonate another user or person or use the username of another user;
use any information obtained from the App in order to harass, abuse, or harm another person;
attempt to bypass any measures of the App designed to prevent or restrict access to the App, or any portion of the App;
upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the App or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the App;
disparage, tarnish, or otherwise harm, in Zurich’s sole opinion, other users, Zurich and/or the App.

The App is designed only for the sharing of information that qualifies as “Public” or “Internal Use Only” as defined by the Zurich Risk Policy. You must not post any “Confidential” or “Highly Confidential” information on the App.

ANY ATTEMPT BY ANY PERSON TO DAMAGE THIS APP OR UNDERMINE ITS OPERATION MAY BE A VIOLATION OF CRIMINAL OR CIVIL LAWS. ZURICH RESERVES THE RIGHT TO TAKE LEGAL ACTION AGAINST ANY SUCH PERSON.

Updates

Zurich may make updates available to you to improve the App's performance, fix bugs, address security issues, enhance functionality, and/or improve the user experience. You agree to download and install such updates on a timely basis to ensure the continued functionality of the App. Failing to install an update could leave the App and your device vulnerable to security threats and/or restrict, limit or impair the functionality of the App.

Disclaimer / Limitation of Liability

The content, material and information on this App are provided “as is” and “as available” with no warranties or guarantees of any kind. We hereby disclaim any explicit or implied guarantee in relation to this App and to any results arising through the use of this App and its content, including but not limited to all guarantees regarding common commercial practice and suitability for a specific purpose or usage.

In addition, there is no guarantee offered to the effect that access to this App shall be without interruption or error, or that defects and errors shall be resolved. We accept no liability for poor Internet performance or imported data of all types (e.g. infiltration of viruses). We may experience hardware, software, or other problems or need to perform maintenance related to the App, resulting in interruptions, delays, or errors.

We reserve the right to change, modify, or remove the content, information, materials, features or functions of the App at any time or for any reason at Zurich’s sole discretion without notice. However, we have no obligation to update any information on the App. We also reserve the right to modify or discontinue all or part of the App without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the App.

The information and content provided on this App is reviewed and updated regularly. Despite every care, it is possible that information and the content and/or facts will change over time. Therefore, we cannot accept any liability or provide any guarantee for the topicality, correctness or completeness of the information or content provided.

TO THE EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ZURICH, NOR ANY OF ITS SUBSIDIARIES OR AFFILIATES, BE LIABLE TO ANY PARTY FOR ANY COST OR DAMAGES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, ARISING OUT OF OR IN CONNECTION WITH THE ACCESS OR USE OF, OR THE INABILITY TO ACCESS OR USE THE APP OR ANY OF ITS FUNCTIONS OR FEATURES, INCLUDING IN CONNECTION WITH ANY ACCESSING OR DOWNLOADING OF ANY INFORMATION, DATA, TEXT, IMAGES, OR OTHER MATERIAL ACCESSIBLE THROUGH THE APP OR ANY OTHER APPLICATIONS, INFORMATION, CONTENT OR WEBSITES LINKED TO THIS APP.

Intellectual property

Except as indicated otherwise, all intellectual property, especially copyright and trademark rights, and similar rights in the information, text, graphic images, logos, features or functions, and layout (including the “look and feel”) contained in this App are the exclusive property of Zurich, and may not be copied, reproduced, posted, transmitted or distributed, in whole or in part, in any form (electronic or written) without first having obtained Zurich's express written consent (except for the below).

“Zurich” and its brand and logos used in the App are registered trademarks and the exclusive property of Zurich. Any and all reproduction, copying, transmission, distribution or other use of these brands and logos is prohibited without the prior written consent of Zurich.

Nothing in this App should be construed as granting a license or any other right to use any copyrights, trademarks or logos. Moreover, the downloading, printing or other replication of any materials in this App will not result in the transfer, explicit or implied, of any rights. You may, however, download, print or otherwise replicate the information, content and material in this App for personal, non-commercial use only, provided you do not remove any copyright or other proprietary right notice.

The copyright in some documents, content and other material available in this App may belong to third parties and as such have been produced on this App with the permission of the third-party copyright owners. You must check copyright notices on or in respect of such documents or material before using it.

Third-party Applications, Websites or Content

Some of the Services provided in this App may be operated by third-party services providers. Such Services and links from this App to third-party applications, websites or content via hyperlinks are provided for your information and convenience only. Zurich does not investigate, review or monitor the linked applications, websites or third-party content for accuracy, appropriateness, or completeness. Some third-party applications or websites may be provided by third parties domiciled outside your country and subject to different regulators and rules or hosted in such countries.

Zurich is not responsible for these third-party applications, websites or content reached as a result of these links including the content, accuracy, offensiveness, opinions, reliability, privacy practices, or other policies of or contained in these third-party applications, websites, links or content. Zurich hereby explicitly dissociate themselves from all content in all linked sites and disclaim ownership of said content.

A link from the App to third-party application, website or content does not constitute a referral, endorsement, approval, advertising, offer or solicitation with respect to such application or website, its contents, or any products or services advertised or distributed through that application or website.

If you decide to leave this App and access third-party applications, websites or content directly, you do so at your own risk, and you should be aware these Terms of Use no longer govern. You should review the applicable terms and policies, including privacy and data gathering practices, of any application, website or content to which you navigate from this App or relating to any applications you use or install from this App. Any purchases you make through third-party applications or websites will be through other applications or websites and from other companies, and we take no responsibility whatsoever in relation to such purchases which are exclusively between you and the applicable third party.

Termination

These Terms of Use shall remain in full force and effect while you have installed the App and use it from time to time. Without limiting any other provision of these Terms of Use, Zurich has the right to deny access to and use of the App, to any person for any reason or for no reason, including without limitation for breach of any representation, warranty, or covenant contained in these Terms of Use or of any applicable law. Zurich may, in its sole discretion, terminate your use of the App and the services connected thereto or delete your account and any content or information that you posted, at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms of Use or any applicable law.

You can choose to stop using the App at any time by removing the App from your device.

All provisions of the Terms of Use which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Miscellaneous

Zurich’s failure to exercise or enforce any right or provision of these Terms of Use shall not be construed as a waiver of such right or provision. These Terms of Use apply to the fullest extent permissible by law.

Zurich may assign any or all of its rights and obligations to others at any time. In particular, Zurich may transfer its rights and obligations under these Terms of Use to another Zurich affiliate or other organization. Zurich will always tell you in writing if the transfer is to a third-party organization.

If any provision or part of a provision of these Terms of Use is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms of Use and does not affect the validity and enforceability of any remaining provisions.

Applicable law and jurisdiction

This App and any controversy or claim in connection with it is governed by the substantive laws of US and Canada, depending upon where the employee/user works, without reference to its principles of conflicts of laws. The exclusive place of jurisdiction is Illinois for US-based employee/users and Toronto, Ontario for Canadian-based employee/users.

These Terms of Use are subject to amendments and changes at any time at Zurich's sole discretion to reflect:

changes in law or regulation that affect the App;
industry requirements or standards that affect the App;
changes or updates to the App; or
the way in which we do business.

Accordingly, we suggest that you check these Terms of Use periodically for updates.

If a revision is material, Zurich will endeavor to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined in Zurich’s sole discretion.

You can choose not to accept the changes, but if you choose not to accept them, your right to use the App will end and you must not use the App from the date that the changes come into force. By clicking to accept a change to these Terms of Use or by continuing to use the App after the date that any changes to the Terms of Use take effect, you are agreeing to those changes
