Frequently Asked Questions
What is Professional Liability Insurance for lawyers?
Professional Liability Insurance provides coverage for claims made against a lawyer in the rendering of legal services. It can help protect attorneys against claims of negligence, errors or omissions and other acts that may be broadly defined as malpractice.
What is the difference between claims-made and occurrence-based policies?
With a claims-made policy, the claim must be made and reported during the policy period. With an occurrence-made policy, the circumstances that give rise to a claim must occur during the policy period, but the claim can be reported later.
What is “tail coverage” and why do I need it?
An Extended Reporting Period (ERP) Endorsement is also sometimes called “tail coverage.” ERP endorsements extend the time to report a claim past the termination date of the policy. There are very specific requirements for a claim to be covered by an ERP, as well as limitations defined in the endorsement. An ERP is typically not available when a policy is canceled for non-payment. Zurich offers tail coverage at no cost in certain circumstances, such as retirement, death or disability.
What factors affect the cost of Professional Liability Insurance for lawyers?
The price of a policy is determined by factors including but not limited to the number of attorneys, area of practice, the geographic territory, the requested limits and deductible, claims history and risk management practices.
